Covenant Enforcement

The Brown Law Group provides pre-litigation and non-litigation enforcement services including enforcement letters, advice for boards of directors, and assistance in conciliation efforts. BLG believes that litigation concerning covenant enforcement is, in most cases, not beneficial to either the Association or the complaining member. With that in mind, our firm handles enforcement matters with a three (sometimes four) letter process prior to filing a lawsuit.

Litigation

The Brown Law Group aggressively litigates document enforcement matters and provides cost-effective defense to community associations that are sued. BLG’s philosophy is that litigation is generally a lose-lose for the both the Association and the Owner, and often for the firm. Over time we have found that even when completely successful; the division the litigation causes within the the Board and community, the months and years cases take to move through the court system, and the expense of the case unduly strains the relationship with our client.

General Association Governance

The Brown Law Group represents community associations in initial formation, election and voting issues, amendment of articles of incorporation, amendment of bylaws, amendment of CC & R1s, interpretation of governing documents, opinion letters, assessment issues, transfers and acquisitions of property, and other corporate issues.

Assessment Collection

The Brown Law Group is a leading provider of assessment collection legal services in Arizona. Services include collection demand letters, recording of notices of lien, foreclosure and judgment enforcement and collection. If we don’t collect, we don’t eat. Our firm offers a EWYK (“Eat What You Kill”) contingent fee retainer agreement where BLG collects assessments for no charge to the Association, except for foreclosures in certain cases.
